5. SMS Terms

Program Description

Clear Wellness Way offers an SMS program that provides educational briefings, wellness tips, and information about sleep improvement and general wellness topics. By opting in to receive SMS messages, you will receive periodic text messages with educational content.

Supported Carriers

Our SMS service is available on participating carriers including but not limited to AT&T, T-Mobile, Verizon, Sprint, Boost, Cricket, MetroPCS, U.S. Cellular, Virgin Mobile, and others. Not all carriers are supported. Check with your carrier for availability.

Carrier Liability

Mobile carriers including T-Mobile and other participating carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier network availability and other factors outside our control.

Data and Privacy

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

YOU AND CLEAR WELLNESS WAY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions

Notwithstanding the above, either party may seek equitable relief in court for infringement or misuse of intellectual property rights.
